Updates 10/26/2011
 
Hey all, been a while since I've written one of these! :P Anyways, I've decided to update you guys on a few things behind-the-scenes. First off, although I haven't been updating anyone on newer game productions, I will state that we are working on some pretty cool stuff, including what may be our largest game yet. We contacted Wigshop Records a while back about maybe using ES Posthumus songs in Ilxder: the Adventure Begins. (Still waiting for a response there :P )

On the job/team aspect - we're no longer taking on ANYONE who wants to join. We now are only taking on ones who seem passionate, determined, dedicated, and hard-working. We still DO NOT take into account their experience (unless they have no experience in ANY of the openings ;) ), but rather those four factors. We have a position open for an internal architect/mentor whom would help train the people with lesser experience how to work with some of the stuff, so if you enjoy acting like a mentor/teacher and you have EXTENSIVE knowledge in game programming and design, check it out! :) See, we don't believe in the saying "Beggars can't be choosers" for two reasons. 1) We're not begging for team members, and 2) We believe that only the most passionate, determined, dedicated, and hard-working individuals are the ones that a team should have. Numbers don't make much of a difference if you've a team that's so dedicated and passionate. ;)

And here's a very minor website upgrade - we fixed an odd bug in the logo. We fixed it so it's much more smooth-looking.

Hiya.

I won't lie, this is a pretty silly post. But that's not what I want to write about here.

I read this bit in a news post on your front page:
"we've decided to take the road that avoids lawsuit (although we'd likely win)"

Unless you have both the time and money to pay for a lawyer to fight the corporation (legally speaking), there's absolutely no way you'd win.

So here's the deal: you obviously cannot argue your side in court on your own. Unless you have proper training, no one can. So, you would need a lawyer. Now lawyers are clever business men. Lawyers like those that you see on TV who offer restitution for common cases like insurance claims are willing to start working for free because they are confident that they can win the case and get a share of the spoils. And because these cases are common they know that they don't have to look hard or exert too much effort to do their job well. Basically speaking, they've got their little gold mine which they are content to dig from for their entire career, and they won't help people like you who have extremely special cases for a chance at some chump change, frankly put. In other words (and in terms of the lawyer), it's a case of the bird in the hand versus the bird in the bush.

So these things said, I'm going to point out that if such a civil case arose between you and Dimension Software, you would have to spend a lot of time and money just to find a lawyer willing to pick up the case, and I'm not even going to mention the task of actually affording his services. So assuming you have no money to pay for a lawyer, and considering the fact that you can't argue your side in court without one, it should be understood that, legally speaking, you'd be dead in the water under the terms of this scenario.

Now, you're right in that your potential plaintiff wouldn't have much of a case to begin with, but since you can't fight them yourself, you would absolutely have to give in to their demands, regardless of the aforementioned fact. These things said, the name change was a wise decision.

Hey there Sheridan, long time no see! :)

I realize that now that you pointed that out, thanks! I changed the news post. One thing I would like to point out though, is that if people can't afford lawyers (at least it's this way in the US), the court provides a lawyer. Yeah, sure, it may not be the best lawyer in the world, but it's a lawyer regardless.

But that's not the point. The point is, I am trying to avoid lawsuit as much as possible. ;)

Good point, I had forgotten that the court system will provide lawyers to those that can't afford them. Nonetheless, I wouldn't depend on that too much. You're right. ;)

Haha, yeah, but I have heard that sometimes the court lawyers are better, but I'd rather just avoid it at all costs haha
